SMS Terms & Conditions

Introduction

These SMS Terms and Conditions (the “Terms”) govern your use of the SMS text messaging services (“Services”) offered by Safepay, LLC (“Safepay,” “we,” “us,” or “our”). By enrolling in, using, or otherwise participating in our SMS Services, you agree to these Terms.

Safepay may use SMS to provide:

  • Account Notifications & Appointment Reminders
  • Transaction Alerts & Security Messages

By opting into these Services, you consent to receive SMS messages to the mobile number you provide.

 

Definitions

  • “SMS” means short message service, commonly referred to as text messaging.
  • “Customer” means a business client of Safepay that subscribes to Safepay’s solutions.
  • “Subscriber” means the end user or recipient of SMS sent through Safepay.
  • “Carriers” means mobile network operators that deliver SMS messages

 

Provision of Services

Safepay agrees to provide SMS Services in accordance with these Terms.

  • Message frequency may vary. You may receive account, security, or appointment messages as needed.
  • Message and data rates may apply depending on your carrier and plan.

 

Customer and Subscriber Obligations

By using our Services, you agree not to use SMS messages to:

  • Send unlawful, fraudulent, abusive, or objectionable content.
  • Transmit malware, spyware, or harmful code.
  • Interfere with, disrupt, or attempt unauthorized access to Safepay’s systems.
  • Violate any applicable federal or state laws, including the Telephone Consumer Protection Act (TCPA).

 

Confidentiality

Safepay uses reasonable safeguards to protect subscriber information. However, SMS travels over networks outside of our control, and absolute security cannot be guaranteed.

 

Carrier Disclaimer

Carriers are not liable for delayed or undelivered messages. Service availability may vary depending on your carrier’s network coverage.

 

Opt-In & Opt-Out

  • By providing your mobile number, you consent to receive SMS messages from Safepay.
  • Phone numbers collected for SMS will not be shared with third parties or affiliates for marketing purposes.
  • You may opt out at any time by replying “STOP” to any SMS message. After opting out, you will receive a confirmation SMS, and no further messages will be sent unless you re-subscribe.

Disclaimer of Warranties

Safepay provides SMS Services “as is” without warranties of any kind, express or implied. We do not guarantee error-free or uninterrupted delivery.

 

Limitation of Liability

To the fullest extent permitted by law, Safepay shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use the Services.

 

Termination

  • Subscribers may cancel SMS participation at any time by texting STOP or contacting Safepay.
  • Safepay may suspend or terminate Services for violations of these Terms.

 

Governing Law

These Terms are governed by the laws of the State of Texas and applicable federal laws of the United States.

 

Amendments

Safepay reserves the right to update these Terms at any time. Updates will be posted on our website at https://safepayllc.net. Continued use of the Services after changes constitutes acceptance of the updated Terms.

 

Assignment

You may not assign your rights under these Terms without Safepay’s written consent. Safepay may assign its rights and obligations without restriction.

By using Safepay’s SMS Services, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
